1. Introduction

Welcome to AffiliateReviewz ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the AffiliateReviewz website, services, and applications (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Definitions

Throughout these Terms, we use specific terminology to refer to different users and components of our Platform:

  • Network: Affiliate networks, advertisers, or merchants who offer affiliate programs and promotional opportunities.
  • Publisher: Affiliates, bloggers, content creators, or marketers who promote offers from Networks.
  • Offer: A promotional opportunity provided by a Network that Publishers can apply to promote.
  • Wishlist: A list created by Networks to identify Publishers they would like to work with.
  • Review: Feedback provided by Publishers about Networks or by Networks about Publishers.

3. Account Registration and Eligibility

To access certain features of the Platform, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself.

You must be at least 18 years old to use our Platform. By using the Platform, you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Types and Specific Terms

4.1 Networks

As a Network, you agree to:

  • Provide accurate information about your company, offers, and payment terms.
  • Honor the terms of your offers and pay Publishers in accordance with your stated payment terms.
  • Maintain accurate tracking of Publisher performance and conversions.
  • Provide timely responses to Publisher applications and inquiries.
  • Use the Wishlist feature responsibly and in accordance with these Terms.
  • Provide honest and fair reviews of Publishers based on actual experiences.

4.2 Publishers

As a Publisher, you agree to:

  • Provide accurate information about your websites, traffic sources, and promotional methods.
  • Comply with the specific terms of each offer you promote.
  • Not engage in fraudulent activities, including but not limited to generating fake leads or sales.
  • Not use deceptive marketing practices or misrepresent offers to consumers.
  • Provide honest and fair reviews of Networks based on actual experiences.

5. Platform Features

5.1 Offers

Networks may post offers on our Platform for Publishers to apply to promote. We do not guarantee the accuracy, quality, safety, or legality of these offers. Publishers should conduct their own due diligence before applying to or promoting any offer.

Networks are solely responsible for the terms, conditions, and fulfillment of their offers, including tracking, reporting, and payment to Publishers.

5.2 Wishlists

Networks may create Wishlists to identify Publishers they would like to work with. Inclusion in a Wishlist does not guarantee acceptance into a Network's program or approval to promote specific offers.

Publishers will be notified when they are added to a Network's Wishlist and may choose to contact the Network or apply to their offers.

5.3 Reviews

Users may leave reviews about Networks or Publishers based on their actual experiences. Reviews must be honest, fair, and comply with our Content Guidelines.

We reserve the right to remove reviews that violate these Terms or our Content Guidelines, but we do not actively monitor or edit review content.

6. Content Guidelines

You are solely responsible for all content you post on our Platform, including but not limited to offer descriptions, company profiles, reviews, and communications with other users.

You agree not to post content that:

  • Is false, misleading, or deceptive
  • Is defamatory, harassing, abusive, or threatening
  • Infringes on the intellectual property rights of others
  • Contains malware, viruses, or other harmful code
  • Promotes illegal activities or violates applicable laws
  • Contains adult, obscene, or pornographic material
  • Discriminates based on race, gender, religion, nationality, disability, sexual orientation, or age

We reserve the right to remove any content that violates these guidelines or these Terms.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Platform for any illegal purpose or in violation of any applicable laws
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform
  • Using automated means, including spiders, robots, crawlers, data mining tools, or similar methods to scrape or extract data from the Platform
  • Bypassing the measures we may use to prevent or restrict access to the Platform
  • Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity
  • Engaging in fraudulent activities, including generating fake leads, sales, or traffic
  • Manipulating identifiers to disguise the origin of any content transmitted through the Platform
  • Posting false or misleading reviews or ratings

8. Intellectual Property Rights

The Platform and its original content, features, and functionality are owned by AffiliateReviewz and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain ownership of any content you post on the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing and promoting the Platform.

9. Third-Party Links and Content

Our Platform may contain links to third-party websites or services that are not owned or controlled by AffiliateReviewz. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AFFILIATEREVIEWZ AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEITHER AFFILIATEREVIEWZ NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE PLATFORM WILL BE ERROR FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED.

11. Limitation of Liability

IN NO EVENT WILL AFFILIATEREVIEWZ, OR ITS SUPPLIERS OR LICENSORS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THESE TERMS UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR: (I) ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES; (II) THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES; OR (III) FOR INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA.

12. Indemnification

You agree to indemnify and hold harmless AffiliateReviewz, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Platform, including but not limited to your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
